TERMS & CONDITIONS – CATERING, FUNCTIONS AND EVENTS

By confirming a booking with Topi Catering, the organiser agrees to comply with the following terms and conditions.

Booking Conditions & Acceptance of Terms

Customers are advised to carefully review all terms and conditions related to their event. The agreement must be properly dated, signed, and returned within the specified timeframe, accompanied by the required deposit payment.

Booking Conditions & Acceptance Of Quote

The Customer is asked to read carefully all the provisions of the Contract concerning their function. The Contract must be duly dated, signed, and returned by the customer within the appointed time with the required deposit payments. If Topi Indian Catering + Events accepts a change to the Contract signed by both parties, a new Contract offer shall be drawn up which shall cancel the previous offer.

Pending Bookings

Pending bookings will be held for a period of 1 month. If not confirmed during this time, and every effort has been made to contact the client, the booking will be cancelled.

Payment Terms

A 50% deposit is required to secure your booking. The remaining balance must be paid in full no later than 14 days prior to the event. Any additional costs incurred (e.g., unreturned items, extended staff hours, or damages) will be invoiced after the event.

Payment can be made via cash or EFT with invoice/order number. Alternatively, you can call, and we can take your credit card payment over the phone. Please note there is a 1.5% credit card fee.

Menu Selection & Amendments

Final menu selections must be confirmed no later than 14 days before the event date. Changes requested within 14 days of the event will be considered at the sole discretion of Topi Catering. While we will do our best to accommodate changes, they cannot be guaranteed. If specific ingredients are unavailable due to supply issues, suitable alternatives may be offered.

Final Guest Numbers

Final attendance numbers must be confirmed no later than 10 days prior to the function. If no confirmation is received, you will be charged based on either the original contracted number or the actual number of attendees—whichever is greater.

Dietary Requirements

Final dietary requirements must be provided no later than 10 days prior to the booking date. Requests for changes or additions within 10 days prior to a function will be considered at the sole discretion of Topi. We will do everything possible to facilitate your requests, but not all changes can be guaranteed and substitutions may be suggested where items are not available.

Sunday & Public Holiday Surcharge

Events held on a Sunday will incur a surcharge of 75% on staffing costs due to award changes.

Events held on public holidays will incur a surcharge of 20% on food and 75% on staffing costs due to award changes.

Safe Food Transport

All food must be transported in a refrigerated vehicle. For large-scale events requiring additional or larger refrigerated vehicles, an extra charge will apply based on the guest count and the volume of food, beverages, or equipment being transported.

Responsible Service Of Alcohol

Topi upholds the principle of Responsible Service of Alcohol and in accordance with the applicable liquor license, reserves the right to refuse service to persons suspected to be under the age of eighteen years and to any person who shows signs of intoxication.

Equipment & Bond

Topi can arrange all necessary equipment for your event on your behalf. Please note that while we facilitate the hire, we are not responsible for any damage to or loss of hired equipment. Additionally, Topi accepts no liability for any injury or incident resulting from the use of this equipment.

Depending on the quantity and nature of the equipment required, Topi reserves the right to charge a bond of up to $1,000. The decision to apply this bond is at Topi’s sole discretion. If applicable, the bond must be paid no later than 14 days prior to the event date. The bond will be reconciled after the event, and any deductions for damages, loss, or additional charges will be communicated accordingly.

Marketing & Media Disclaimer

Please be aware that photography and videography may take place at events catered by Topi. We will always seek permission from the event organizer before engaging any external photographers or videographers.

By attending a Topi catered event, you and your guests grant consent for any images or footage captured to be used by Topi for promotional, marketing, and social media purposes, unless otherwise agreed in writing prior to the event.

Additional On Day Coordination

Topi provides on day coordination strictly related to catering and service staff, including the setup of catering related equipment such as buffet, cutlery, crockery, and kitchen areas.

Any coordination outside of our standard catering scope such as managing weather related adjustments, styling decisions, or the setup and pack down of dining area, or collection of items not supplied or arranged by Topi will incur an additional fee of $75.00 per hour. These services are subject to staff availability and will be charged accordingly.

Health & Safety Disclaimer

Topi Catering is not responsible for food that is taken away or left behind after the event. While we take care to label allergens and dietary information, all food is prepared in a commercial kitchen where all 14 major allergens are present, including seafood, nuts, sesame, gluten, eggs, dairy, and soy. We cannot guarantee the absence of allergens and accept no liability for allergic reactions.

Advance Bookings & Price Adjustments

For events scheduled more than 6-12 months in advance, Topi Catering reserves the right to adjust pricing in response to changes in supplier or operational costs. A price increase of up to 10% may be applied within 3 months prior to the event date, if necessary. More may be applicable for event booked over 12 months in advance.

Cancellation Policy

Cancellations must be submitted in writing. The following cancellation charges apply based on the notice period:

Postponement

All requests to postpone a booking must be submitted in writing. The rescheduled date must fall within 12 months of the original event date, unless an alternative arrangement is agreed upon in writing. New dates are subject to availability.

Any payments made up to the date of postponement will be transferred to the rescheduled event. However, Topi Catering reserves the right to retain part or all of the deposit to cover administrative and service-related costs incurred.
